This privacy policy has been prepared and is maintained in accordance with all applicable national and international laws and regulations and, in particular, the Personal Information Protection and Electronic Documents Act (PIPEDA), the California Consumer Privacy Act (CCPA) and the Data Protection Act 2018 (UK regulations).

2. HOW WE OBTAIN CONSENT

By downloading and using the mobile application, registering as a user on the platform, using the services available on the platform (sending international remittances), contacting us through our contact details and providing us with personal information to communicate with you, you consent to our collection, storage and use of your information under the terms set out in this privacy policy.

 

3. TYPES OF INFORMATION COLLECTED

The information we collect from our users helps us to continually improve the user experience on the platform. These are the types of information we collect:

Information you provide to us. You provide information when you download and use the mobile application, register as a user, use the services available on the platform (sending international remittances), contact us through our contact details and contact forms, and provide personal information to communicate with you. As a result of those actions, you may provide us with the following information:

·        Date of birth

·        National identification number

·        Identification documents (ID, driver's license)

·        Bank details (debit card information, holder's name, beneficiary's bank account)

·        Household information (utility bills)

·        Contact information (address, phone number, email)

Digital Wallet Data: When you use our services, we collect and store data related to your financial transactions, including:

·        Transaction history

·        Wallet balance

·        Payment information

Information Collected Automatically: By accessing and using the platform, you automatically provide us with the following information:

·        Your IP address

·        Referrer URLs

Location: We store real-time information about the location of users when they use the services available on the platform, authorizing and sharing their location through the GPS function incorporated in the mobile devices of each user. This information is stored and processed for purposes of user security and verification of transactions made by users. This information is processed for the time necessary for the proper provision of services and is stored in the history of each user. The user can request the deletion of such information or disable the GPS function of their mobile device, but certain functionalities of the platform would not be available. Location information collected through the platform will be treated in accordance with this privacy policy.

Firebase (Mobile app): We use Firebase Crashlytics and Firebase Analytics provided by Google, Inc. of the United States ("Google") and certain functionalities such as Firebase Crashlytics, Firebase Analytics, Google Analytics, Cloud Firestore, Firebase Performance Monitoring, Firebase Dynamic Links, Firebase Authentication, etc. These tools and technologies collect and analyse certain types of information, such as feature usage metrics and statistics, usage history, unique device identifiers and other similar information. The information generated by Firebase may be transmitted to and stored by Google on servers in the United States. We use Firebase to improve our platform.

Contact information: We may access some personal information about the user, such as name and email address, when the user or any third party communicates with us through our contact information. Personal information provided through our contact information is not stored on any GxPay server and will be stored on the respective server of our email service.

 

4. HOW LONG DO WE KEEP YOUR DATA?

Personal data provided by users through the platform and our services will be retained for the time necessary to provide the functionalities available on the platform, to facilitate the sending of international shipments, to fulfill the legitimate purposes described in this policy, or until the user decides to close their user account or requests the deletion of their data. GxPay may retain personal data for a longer period provided that the user has consented to such processing, as long as such consent is not withdrawn. In addition, GxPay may be obliged to retain personal data for a longer period if this is required for compliance with a legal obligation or by order of an authority. Once the retention period has expired, the personal data will be deleted. Therefore, the right of access, the right of deletion, the right of rectification, and the right to data portability cannot be asserted after the retention period has expired.

 

5. HOW DO WE USE YOUR INFORMATION?

In general, we use the information we collect primarily to provide, maintain, protect, and improve our platform and to provide the functionalities available on the platform appropriately. We use personal information collected through our platform as described below:

·        Provide the functionalities available on the platform.

·        Facilitate the sending of remittances to the beneficiaries.

·        Verify the identity of our users (KYC).

·        Resolve user disputes, cancellations, and refunds.

·        Understand and improve your experience using our platform and services.

·        Respond to your comments or questions through our contact information.

·        Send you related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.

·        Send you relevant information about GxPay .

·        GxPay marketing purposes.

·        Link or combine your information with other data we obtain from third parties to help us understand your needs and provide you with better service.

·        Protect, investigate and deter fraudulent, unauthorised or illegal activities.

 

6. HOW WE SHARE INFORMATION

Information about our customers is an important part of our business, and we are not in the business of selling it to others. We share customer information only as described below.

Third-Party Service Providers. We use third party services to perform certain functions on our platform. Some of these functions and services include: building and hosting the platform, processing payments, sending e-mails, and performing tracking and analytics functions on the platform (Firebase Crashlytics, Firebase Analytics).

These third-party services and tools may have access to personal information needed to perform their functions, but may not use that information for other purposes. Information shared with these third-party services will be treated and stored in accordance with their respective privacy policies and our privacy policy.

Third-party partners: By using our services, you agree that we may share your personal information with partners related to remittance services and technology partners, including those offering API solutions, among others. Such sharing is essential in order to provide you with our functionalities in an optimal manner and to ensure the proper functioning of the associated services. These partners are committed to protecting your information and using it only for the purposes necessary to provide their respective services.

Marketing: By using our services and platform, you consent to the use of your personal information, including name and email address, for the sole purpose of receiving marketing communications about our platform and services. GxPay respects your privacy and does not share this information with unaffiliated third parties. If you wish to stop receiving marketing communications, you can unsubscribe at any time by using the "unsubscribe" option available in the same marketing emails or by sending your request through our contact information.

Business Transfers. In the event GxPay creates, merges with, or is acquired by another entity, your information will likely be transferred. GxPay will send you an email or post a prominent notice on our platform before your information becomes subject to another privacy policy.

Protection of GxPay and Others. We release personal information when we believe release is appropriate to comply with the law, enforce or apply our terms and conditions and other agreements, or protect the rights, property, or safety of GxPay , our users, or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction.

Anonymous Information. GxPay uses anonymous browsing information collected automatically by our servers primarily to help us administer and improve the platform. We may also use aggregated anonymous information to provide information about the Platform to potential business partners and other unaffiliated entities. This information is not personally identifiable.

 

7. DATA BREACH NOTIFICATIONS

In the event of a security breach that compromises the confidentiality of the personal data of our users, GxPay undertakes to notify those affected in a timely manner. This notification will be made through the means of contact that have been provided by the user on our platform. We will take all reasonable measures to protect the information and remedy any situation that compromises the security of your data.

 

8. INTERNATIONAL DATA TRANSFER:

By using our platform, you agree that your personal data may be transferred and processed outside your home country, where data protection laws may be different from those of your country. GxPay is committed to taking the necessary steps to ensure that your data is treated in accordance with applicable privacy protection rules and is adequately protected during any international transfer.

 

9. PROTECTION OF YOUR INFORMATION

We restrict authorised access to your personal information to those persons who have a legitimate need to know that information and to those persons you have authorised to have access to that information. GxPay follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once GxPay receives it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while GxPay strives to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.

Users who provide information through our platform, as data subjects, have the right to access, rectify, download or delete their information, as well as to restrict and oppose certain processing of their information. While some of these rights apply generally, others only apply in certain limited circumstances. These rights are described below:

·        Rectification, restriction, limitation and deletion: You may also rectify, restrict, limit or delete much of your information.

·        Right to be informed: Users of our platform will be informed, upon request, about what data we collect, how it is used, how long it is kept and whether it is shared with third parties.

12. PROTECTION OF CHILDREN'S ONLINE PRIVACY

We comply with the requirements of state and federal data protection regulations regarding the protection of personal data of minors. Our platform and services are intended for persons over 18 years of age. We do not collect any information from children under the age of 18. If we become aware that a child under the age of 18 has provided us with personal information, we will take steps to delete that information.

GxPay is not responsible for the privacy or security practices of another Internet platform, including those linked to or from the GxPay platform.
